Terms of Service

1. Acceptance of Terms

By accessing or using DoctorReviews.in (the "Platform"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Medical Disclaimer. If you do not agree, please do not use the Platform.

These Terms constitute a legally binding agreement under the Indian Contract Act, 1872, and the Information Technology Act, 2000.

2. Eligibility

• You must be at least 18 years old to use this Platform
• You must be capable of entering into a legally binding contract under Indian law
• You must not be barred from using the Platform under any applicable law

3. Nature of Platform

DoctorReviews.in is an information and review aggregation platform. We:

• Display publicly available NMC doctor registration data
• Host user-submitted reviews of doctors and hospitals
• Provide informational tools (symptom checker, blood bank locator, etc.)

We do NOT:

• Provide medical advice, diagnosis, or treatment
• Endorse or guarantee any doctor's services
• Verify the accuracy of every user review (we use OTP verification but cannot independently verify clinical claims)
• Act as a medical service provider, hospital, or pharmacy

4. User Reviews and Content

4.1 What you can post

• Honest experiences with doctors and hospitals
• Constructive feedback on service quality, wait times, communication
• Factual descriptions of treatment outcomes

4.2 What you must NOT post

• False or fake reviews (fake positive reviews, paid reviews, competitor sabotage)
• Defamatory content (false statements that harm reputation)
• Personal information of doctors beyond what is publicly available (home address, family details)
• Medical advice directed at other users
• Hate speech, threats, abuse, harassment
• Content that violates IT Act 2000 Section 67 (obscene, sexually explicit material)
• Copyrighted material you don't own
• Spam, advertising, promotional content
• Misleading medical claims in violation of Drugs and Magic Remedies Act, 1954

4.3 Review verification

All reviews require OTP verification. We may additionally verify reviews through other means before publication. We reserve the right to remove or refuse any review without notice.

4.4 License you grant us

By submitting a review, you grant us a perpetual, royalty-free, worldwide license to use, display, modify, and distribute your review on the Platform and in promotional content (always with your first name only — never your phone number).

5. Doctor Profile Information

Doctor information displayed is sourced from the National Medical Commission (NMC) Indian Medical Register, a publicly available database. If you are a doctor and find inaccurate information about your profile:

• Email doctors@doctorreviews.in with proof of identity (NMC ID, government ID)
• We will correct verified inaccuracies within 7 working days
• Reviews will not be removed unless they violate Section 4.2

6. Acceptable Use

You agree NOT to:

• Use bots, scrapers, or automated tools to access the Platform
• Attempt to gain unauthorized access to our systems
• Interfere with the Platform's functionality (DDoS, malware, exploits)
• Reverse engineer or copy our code/database
• Use the Platform to harm any individual or entity
• Impersonate another person or doctor

Violation may result in immediate termination of access and legal action under Section 43, 65, 66 of the IT Act 2000.

7. Intermediary Status (IT Act Section 79)

DoctorReviews.in is an "intermediary" as defined under Section 2(1)(w) of the IT Act 2000. We host third-party content (reviews) and qualify for safe harbour protection under Section 79.

We do not actively monitor every review but will:

• Remove unlawful content within 36 hours of receiving a valid takedown notice
• Cooperate with law enforcement on lawful requests
• Maintain a Grievance Officer (see Privacy Policy Section 11)

9. Limitation of Liability

To the maximum extent permitted by law, DoctorReviews.in, its operators, and affiliates shall NOT be liable for:

• Any decisions you make based on information from the Platform
• Outcomes of medical treatment from any doctor or hospital listed
• Errors, omissions, or inaccuracies in user reviews
• Indirect, incidental, special, or consequential damages
• Damages exceeding ₹1,000 (one thousand rupees) in aggregate

10. Indemnification

You agree to indemnify and hold harmless DoctorReviews.in, its operators, employees, and affiliates from any claims, damages, or expenses arising from:

• Your reviews or content posted on the Platform
• Your violation of these Terms
• Your violation of any third-party rights (defamation, privacy, IP)
• Your medical decisions or actions taken based on Platform content

11. Account Termination

We may suspend or terminate access at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent activity
• Legal compliance requirements
• Extended inactivity

You may stop using the Platform at any time. Reviews you've posted may remain visible per the license in Section 4.4.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via:

• Banner notice on the homepage for 30 days
• Email to registered users (if applicable)

Continued use after changes constitutes acceptance.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.

Before initiating legal proceedings, both parties agree to attempt good-faith resolution through our Grievance Officer.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
